The East half of Lot 4, Block 2, WYNNS ADDITION to Cottage Grove, as platted and recorded in Book 25, Page 114, Lane County Oregon Plat Records, In Lane County, Oregon.

PROPERTY ADDRESS: 226 East Madison, Cottage Grove, Oregon 97424

The undersigned hereby certifies that no assignments of the trust deed by the trustee or by the beneficiary and no appointments of a successor trustee have been made, except as recorded in the Records of the county or counties in which the above-described real property is situated.  Further, an action has not been commenced to recover the debt, or any part thereof, now remaining secured by the trust deed, or, if an action has been commenced, such action has been dismissed except as permitted by ORS 86.752(7).

There is a default by grantor or other person owing an obligation, performance of which is secured by the trust deed, or by the successor in interest, with respect to provisions therein which authorize sale in the event of default of such provisions.  The default for which foreclosure is made is grantor’s failure to pay when due the following sums:

The principal sum of $44,489.76, with interest on the principal balance at the rate of seven and one half percent per annum, from November 5, 2017, until paid; prepayment premium, if applicable; cost of foreclosure report; attorney's fees, trustee's fees, delinquent property taxes  together with any other sums due or that may become due under the Note or by reason of this foreclosure, costs of insurance and any further advances made by Beneficiary as allowed by the Note and Deed of Trust.

By reason of the default, the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, those sums being the following: Principal balance of $44,489.76 with interest on the principal balance at the rate of seven and one half percent per annum, from November 5, 2017, until paid; Taxes and Assessments, with interest on the principal balance at the rate of sixteen percent (16%) per annum, as follows:

2017-2018, $1487.83 plus interest until paid; 2016-2017, $1,465.81 plus interest until paid; 2015-2016, $1,357.04 plus interest until paid; 2014-2015, $1,327.04 plus interest until paid; 2013-2014, $1,230.54 plus interest until paid; 2012-2013, $1,144.73, plus interest until paid; insurance advances of $1,128.00; Trustee Fees and Attorney Fees of $6,000.00.

Notice hereby is given that both the beneficiary and the trustee, by reason of the default,  have elected and do hereby elect to foreclose the trust deed by advertisement and sale pursuant to ORS 86.705 to 86.815, and to cause to be sold at public auction to the highest bidder for cash the interest in the described property which grantor had, or had the power to convey, at the time of the execution by the grantor for the trust deed, together with any interest or grantor’s successor in interest acquired after the execution of the trust deed, to satisfy the obligations secured by the trust deed and the expenses of the sale, including the compensations of the trustee as provided by law, and the reasonable fees of the trustee’s attorneys.

WHEREFORE. notice is hereby given that the undersigned trustee will on July 9, 2018, at the hour of 10:00 o'clock, A.M., in accord with the standard of time established by ORS 187.110, at the following place: inside the main entrance to the Lane County Courthouse, 125 E. 8th Avenue, in the City of Eugene, County of Lane, State of Oregon, which is hour, date and place last set for the sale.

Other than as shown of record, neither the beneficiary nor the trustee has any actual notice of any person having or claiming to have any lien upon or interest in the real property herein above described subsequent to the interest of he trustee in the trust deed, or any successor in interest to grantor or of any lessee or other person in possession of or occupying the property.

Notice is further given that reinstatement or payoff quotes requested pursuant to ORS 86.745 must be timely communicated in a written request that complies with that statute, addressed to the trustee’s “Urgent Request Desk” either by personal delivery to the trustee’s physical offices (call for address) or by first class, certified mail, return receipt requested, addressed to the trustee’s post office box address et forth in this notice.  Due to potential conflicts with federal law, persons having no record legal or equitable interest in the subject property will only receive information concerning the lender’s estimated or actual bid.

Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying those sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee and attorney fees not exceeding the amounts provided by ORS 86.778.  Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the trustee to state in this notice that some residential property sold at a trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the trustee’s sale.

In construing this notice, where the context so requires, the singular includes the plural, the word "grantor" includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words "trustee" and "beneficiary" include their respective successors in interest, if any, and all grammatical changes shall be made so that this instrument shall apply equally to businesses, other entities and to individuals.

Dated: March 28, 2018. Barry Davis, Attorney at Law, Successor Trustee, Post Office Box 5883, Eugene, Oregon 97405.

NOTICE OF PUBLIC HEARING

PLANNING COMMISSION - CITY OF DRAIN, OREGON

Notice is hereby given that the Drain Planning Commission will hold a public hearing on Monday, May 7, 2018, at 7:00 p.m. in the Meeting Room, of the Drain Civic Center, 205 West "A" Avenue, Drain, Oregon.  The purpose of the hearing is to take public testimony, either written or oral, on a request by Stuart Swearengin for a variance to Section 9.600 (Minimum lot size of 7,000 sq. feet and minimum length of 85’ for a corner lot).  If the variance is granted, the applicant will request a minor land partition to create two parcels.  The subject property is located at 406 S. Cedar St. and is described as Township 22, Range 5, Section 17BD, Tax Lot 0100, on the Douglas County assessor's Map.

Criteria for Decision Making:

A variance in the requirements of the Drain Development Code or Standards Document may be granted if the following criteria are met:  (a) the property owner is unable to enjoy the substantial property rights enjoyed by other in the same zoning classification; (b) the application of rules and regulations would cause an undue or unnecessary practical difficulty or physical hardship, (c) the variance will not be materially detrimental to the purposes of this Code or property in the same zone or vicinity in which the property is located; (d) the variance is consistent with and promotes the objectives of the Comprehensive Plan; and (e) the variance granted is the minimum variance that would alleviate the hardship.

Submitting Testimony:

The applicant and other participants may present evidence and rebut opposing testimony at the hearing.  Prior to the close of the hearing, a participant may request that the record be kept open so that more evidence may be submitted.  After the record is closed, no further testimony may be received.  Failure of an issue to be raised before the close of the final hearing, in person or by letter, or failure to provide information that is sufficiently specific to afford the decision-maker an opportunity to respond to the issue, precludes appeal to the Land Use Board of Appeals (LUBA) based on that issue.

Public Availability of Records and Documents:

All documents, evidence and applicable criteria to be used by the City may be inspected at City Hall.  The staff report will be available for inspection seven days prior to the hearing. Copies of all documents are available at reasonable cost.  For more information, contact Grace McNeil, Drain City Hall, 129 West "C" Avenue, Drain, Oregon 97435.  Telephone: (541)836-2417.
